Transkei arms law scrapped - 14 August
The Mthatha High Court has declared unconstitutional and invalid a
section of the Dangerous Weapons Act
(DWA) that applied only in Transkei because it subjected criminals
there to far "harsher punishment".
While the declaration affects future sentencing, it will bring no
relief to prisoners already sentenced in terms of the Act. - Dispatch

rules against Contralesa ex-chair - 14 August
Former provincial chairperson of the Congress of Traditional
Leaders of South Africa Nkosi Mwelo Nonkonyana yesterday lost the
first round of his court battle to keep his position.
Nonkonyana filed an urgent application with the Mthatha High Court
following his ousting as provincial chairperson more than two
weeks ago.
He said the elective conference was held without his knowledge or
consent, and asked the court to declare it null and void.
He further wanted to interdict the respondents from drawing funds
from the organisation's bank account. Cited as respondents in the
application were new provincial leaders Xolile Ndevu, Ngubo
Mgcotyelwa and Daluxolo Jezile, with the fourth respondent being
Contralesa (Eastern Cape).
Nonkonyana's application was, however, dismissed with costs. The
court found that meetings could be called by the secretary of
Contralesa in consultation with the provincial executive committee
or the chairperson. It also found that funds could be withdrawn
from the organisation's account with any two signatures from the
chairperson, secretary or treasurer. - Dispatch
