Nduna v Absa Bank Ltd and Others [2004]3 All SA 364(C) - the question the Court faced was whether a Magistrate's Court had jurisdiction in ejectment applications.  In casu, the applicant lived at a property in Khayelitsha in the Western Cape.  ABSA, who was the registered owner persuant to a sale in execution of the property, brought an application in the Mitchell's Plain Magistrate's Court for the eviction of the applicant from the premises
Wormald NO and Others v Kambule [2004]3 All SA 392(E) - this matter concerned customary law.  The first applicant was the executor in a deceased estate and that of the surviving spouse (third applicant).  The second applicant was a close corporation (CC) in which the deceased was the sole member.  According to the respondent, she had been married to the deceased according to customary law.  This allegation was disputed by the applicants
Modder East Squatters and Another v Modderklip Boerdery (Pty) Ltd ;  President of the RSA and Others v Modderklip Boerdery (Pty) Ltd [2004]3 All SA 169 - the respondent had obtained an eviction order against thousands of people (eventually some 40 000 were involved) who had been illegally occupying his land, adjacent to Daveyton township.  When the Sheriff was requested to execute the judgment, a deposit of R1.8 million was demanded from the respndent to cover costs
Richtersveld Community v Alexkor and Another [2004]3 All SA 244(LCC) - the Richtersveld Community (plaintiff) claimed restitution of land of which it had been dispossessed after recovery of diamonds on the land.  It also alleged that, after the community had been dispossessed, mining rights had been granted to the first defendant

Draft of property charter offers clarity - 17 December
The first draft of the much-discussed property charter was released on Wednesday for public comment.

The draft entitled Property Charter Draft Framework Version One and which can be read at www.propertycharter.co.za does not contain any targets, but outlines the general principles of the charter, its scope, objectives and why it is necessary.

The first draft also offers clarification on certain contentious issues raised in the media recently, including the question of whether South African companies with diversified business interests will need to comply with the property charter, as well as with the charter that governs their main area of focus.

Andy Tondi, chairman of the executive committee of the property sector transformation charter committee, reiterated his earlier statement that the committee hoped to have targets ready by April next year.

The committee represents the private sector and government through representation by the public works department. Private sector representation includes the South

African Institute of Black Property Practitioners, commercial property association Sapoa, the Women's Property Network, the Estate Agency Affairs Board, the South African Black Technical and Allied Career Organisation, the South African Council of Shopping Centres, the Institute of Estate Agents of SA, the South African Institute of Valuers and the South African Facilities Managers Association.

The first draft of the property charter, which is expected to be ready by the middle of next year, said that each company or group that subscribed to the charter would have to submit an annual black economic empowerment report which has to be verified by an accredited agency.

It said the report would also contain the company's scorecard and an account of progress in achieving the qualitative undertakings of the charter.

It also said that companies that fell within a group bound by another charter would be bound by the requirements of the property charter if the primary business of the company within the group was in property.

Cape eyes levy on property developments - 20 December
Western Cape is to investigate the viability of imposing hospitality and commercial property development levies as a way of generating development funds for the province, premier Ebrahim Rasool said at the weekend.

The additional income is expected to offset the pressures which escalating social spending is placing on the provincial economic development budget.

Rasool said he would call for studies into the feasibility of these new levies next year for possible introduction should national government approve in about three years' time.

Already the province has applied to the national treasury for the go-ahead to charge a fuel levy of 10c/l on motorists, which will raise about R300m for road, rail and other economic infrastructure maintenance.

If the province gets the green light, the levy will probably be imposed towards the end of next year, Rasool said in an interview.

A 10% levy on commercial property development would raise about R250m annually on this year's provincial development projects of about R2,5bn for social housing and property development in under-serviced areas, Rasool said.

A hospitality levy could raise about R100m annually for use in training and marketing of Western Cape's tourism industry.

"If tourism is to become the lifeblood of the future Western Cape economy, then it needs marketing, training for service excellence and empowerment to diversify ownership," Rasool said.

Canada has a 20% development levy, and Ireland and Malaysia have similar taxes.

The Canadians, Rasool found on a recent visit, apportioned fixed percentages of the funds raised to specific purposes such as social projects, arts, culture and small business promotion.

The premier said having additional levy income would allow the provincial government to play a greater role in the development of the province's economy.

He has in the past called for a redefinition of the provinces' role. Rasool would like to see the creation of more fiscal room to allow the provincial government to make strategic interventions to save jobs and open up the "knowledge economy", so they are not simply the social agents for the disbursement of health, welfare and education spending.

"We feel ourselves constrained in this regard. We are not waiting for a conferral of roles or powers from government. We are asking for greater discretion over budget reallocations to make the kind of hard choices that build a sustainable future," he said

Sappi unfazed by forest of new land claims - 23 December

Sappi, the world's largest producer of paper for glossy magazines, faces losing a portion of the plantations that feed its pulp and paper making operations if land claims against it are successful.

"As one of the largest land owners in SA we anticipate that a substantial number of claims may affect land we own," says the group in its annual report, released this week.

Sappi, which is suffering from a protracted low in the global paper cycle, has already been notified of 17 land claims, translating into 6% of the 400000ha of plantations the group owns in SA.

The pulp and paper group was still engaged in a process to determine the extent of possible claims by people who were dispossessed of their land rights, and the extent to which the claims could affect the group, it said in the annual report.

CE Jonathan Leslie yesterday pointed out that the deadline for claims was 1998, but he did not rule out the possibility that more claims existed and that Sappi had not yet been notified of these.

Sappi did not view the process as a threat, but as necessary, said Leslie. He said claims may turn out to be smaller once they were assessed by the land claims commissioner. And where claims were successful Sappi would look to lease the land back from the owners, he said.

No financial provision had been made in terms of land claims, said Leslie. This was mainly because Sappi expected just and equitable compensation from government where land claims succeeded.

An unnamed resources sector analyst said he was not overly concerned about the claims as Sappi had substantial plantations and a lot of flexibility. The claims could, however, add an element of political risk in the view of Sappi's US investors which owned 36% of the group, the analyst said.

The claims, which Sappi said were still under investigation by the Regional Land Claims Commissioner, have been made under the Restitution of Land Rights Act.

The act provides for the restoration of rights in land or other equitable redress to people who were dispossessed of their land rights after 1913 due to race discrimination.

Under the act the land affairs minister can expropriate land to restore it to a successful claimant, provided there is just and equitable compensation to the owner.

Sappi's share price has weakened substantially over the past six weeks since the company released weaker annual results and warned of difficult conditions in the first quarter of its new financial year.

SA ready to discuss Swazi land claims - 21 December
South Africa and Swaziland are to establish a joint committee to investigate Swaziland's claim to SA land along its borders.

This was agreed during Foreign Minister Nkosazana-Dlamini-Zuma's visit to Swaziland at the weekend when she and her counterpart, Mabili Dlamini, signed an agreement to establish a Joint Bilateral Commission (BLC) for Co-operation.

Swaziland has for years agitated for parts of Mpumalanga and KwaZulu-Natal to be transferred to it, claiming they are historically part of Swaziland.

Dlamini-Zuma told a press conference that SA based its claim to the land on the African Union's policy of respecting the borders inherited from the colonial era. But, she said, SA was ready to discuss Swaziland's claim.
The BLC will regulate political, economic, social and cultural relations between both countries.

Dlamini-Zuma emphasised that a framework of operation will have to be agreed upon to ensure that both

nations were able to "speedily meet the challenges of dealing with poverty, unemployment and diseases such as HIV and Aids".

Mabili Dlamini briefed Dlamini-Zuma on Swaziland's constitutional review process, but the SA Foreign Minister did not respond with any concerns from the SA government about the draft constitution which was recently published, department of foreign affairs spokesperson Nomfanelo Kota said.

Multiparty democracy has been banned in Swaziland and activists have been agitating for its reinstatement. The draft constitution written by a constitutional review commission appointed by King Mswati III is ambiguous on this point, upholding the right of political assembly but also asserting that ultimate power lies with the king.

On Tuesday Dlamini-Zuma will host and chair the meeting of the Organ on Politics, Defence and Security of the Southern African Development Community (SADC) in Pretoria.
