While unsatisfactory, it cannot be argued that the private
settlement of South Africa's first-ever excessive pricing case
defied corporate logic. In truth, the fact that the matter reached
the point it did probably had more to do with force of personality
and a desire for a legal precedent than with the core objective of
lowering the cost of doing business in South Africa. The case
turned into a marathon, having been referred directly to the
Competition Tribunal by gold-miners DRDGold and Harmony in 2004,
after the Competition Commission decided not to refer the case,
following its own probe of the matter, initiated in 2002. - Creamer

terms of stolen vehicles 'anti-competitive' - 22
September
The legal counsel of the Vehicle Security Association of South
Africa (Vesa) had warned the association that the stolen car
recovery specifications it set for the accreditation of tracking
products were anti-competitive and a restrictive trade practice,
the Competition Tribunal has heard. Matrix managing director
Stefan Joselowitz admitted he knew of this view before Matrix,
Tracker and Netstar resigned their Vesa membership. - Business

to be ruthless on food price collusion - 22 September
The government will be unrelenting in dealing with suppliers who colluded
on food prices, deputy president Kgalema Motlanthe said on Tuesday.
"It is unacceptable that food prices should be artificially
inflated through the collusive scheming among the major suppliers,
resulting in more misery for the poor," Motlanthe said at the
Congress of SA Trade Union's 10th national congress at Gallagher
Estate in Midrand. "The state will be and is unrelenting in
dealing with these sorts of crimes," he told delegates. - The

Commission uncovers mining cartel activity - 30 September
South Africa's Competition Commission on Wednesday announced the
uncovering of an alleged mining-supply cartel. The findings of the
commission have been referred to the Competition Tribunal, which
has been asked to levy a penalty of 10% on the annual turnover of
three of the four firms named. The four are Aveng Africa's Duraset
; RSC Ekusasa Mining ; Dywidag-Systems International ; and Videx
