Grobler
v Naspers Bpk and Another [2004]5 BLLR 455(C)
Ms Grobler was the unwilling target of
repeated sexual advances by a trainee manager in the
department where she worked as a secretary for a number of
months. When he was finally told where to get off, the trainee
manager drew a firearm and threatened Ms Grobler. Before this,
she had complained a number of times to the department’s
manager, to no avail. When she finally approached the
company’s HR department, the harasser was dismissed. This
was too late. By that time, Ms Grobler was suffering form
post-traumatic stress. After she resigned, Ms Grobbler sued
Naspers and its former trainee manager jointly for R250 000 in
general damages, plus medical costs and compensation for loss
of income. Both the manager and Naspers denied that Ms Grobler
had been harassed ; Naspers pleaded in the alternative
that even if she had been harassed, it was not liable

When she returned to work after maternity
leave, Ms Wardlaw received a notice to attend a disciplinary
inquiry. She was found guilty of failing to discharge her
duties as group financial manager because she had performed
various accounting tasks in a grossy negligent manner, which
resulted in considerable loss to her employer, as well as tax
penalties and interest. Ms Wardlaw was summarily dismissed.
She referred the matter to the Labour Court, claiming that she
was dismissed for reasons that related to the taking of
maternity leave or, alternatively, that even if she had been
negligent, her dismissal was unfair because she had not been
correctively disciplined. She claimed compensation equivalent
to 24 months’ salary |

Whether the minority member of a closed
corporation is an employee as defined in the LRA was the main
issue. After the termination of Mr Le Roux’s relationship
with Afribind CC, he referred a dispute to the CCMA, claiming
that he had been unfairly dismissed. Afribind contended that
Le Roux was not its employee, and that, if he was, there were
good reasons for the termination of relationship and the
termination was procedurally fair |

When Khula Enterprise Management was
restructured, one of its top mangers was required to report to
a newly appointed general manager, rather than to the managing
director, as he had done before. The manager took exception to
the new setup, and arguments followed. The manager was warned,
but the situation eventually deteriorated to the point where
he was dismissed for insubordination and gross negligence. A
CCMA commissioner held that the dismissal was procedurally
unfair because the disciplinary hearing had been presided over
by a practising advocate, rather than an employee, and because
the advocate had been briefed by the company’ attorneys |

The 'right sizing' and transformation
of the public service has led to a sizeable number of disputes
being referred to the Public Service Co-ordinating Bargaining
Council. Most of these complaints concern transfers to places
considered unacceptable by the transferee. The council assumed
jurisdiction to decide these disputes in terms of its own
Resolution 7 of 2002, which governed the 'matching and
placement' process in terms of which employees were
promoted, redeployed or transferred in the process of
transformation |

Ms Tither, a telesales assistant at
Trident Steel, was dismissed after she developed neck pains as
a result of working at her computer. After many absences from
work, medical boarding was considered, but the company’s
pension fund ruled that Ms Tither did not qualify. She claimed
that her dismissal was unfair because the company had not
tried enough to find her alternative employment. Trident Steel
claimed that it had made every reasonable effort to
accommodate Ms Tither, and that she was unable to fulfil her
contractual duties |

Major
revisions to be included in the next GDP figures

The key indicator of economic
growth is gross domestic product (GDP) - the compilation of
the country's national accounts, which are based on a range of
socioeconomic statistics consolidated into a single coherent
system. Four factors not always present will influence GDP
data due for release in November: revision, rebasing,
benchmarking, and improvements in measurement of some economic
sectors

stop government from enacting legislation to control the

Gun
lobby goes to court over new law - 26 June
Gun associations, lobbyists, dealers and owners as well as the
security industry joined forces yesterday to try and suspend
the implementation of the controversial Firearms Control Act,
set for next week. The concerned group served a high court
application on President Thabo Mbeki and the minister of
Safety and Security requesting an order to delay the
implementation of the act on July 1
