Way to go
Eric Way, a fasion designer,  is considering legal action against a grooming salon for the distress caused to Storm, a model Bichon Frise, and himself. He claims that the dog was sent to Pet Pavilion in west London with strict instructions that it should not be heavily trimmed. However, Storm was returned with a short back and sides.

"It is like when you have a beautiful girlfriend who you are proud of. You are not going to take her out if

she hasn't blow-dried her hair. "I am not going to  take Storm out like that. I can't feel like a proud father." Even trying on wigs  brought no improvement to its skinhead look and so Storm's owner said his pet would be spending some time out of the limelight

RAF denies 25c/ hike in petrol price - 24 June
The Road Accident Fund has no plans to force the government to increase the petrol price by 25 cents per litre, the RAF Board says. RAF Board acting chairman Saths Cooper was responding to a report in Sake Beeld that the RAF and the Law Society of South Africa (LSSA) would combine forces to force the government - through a court order if necessary - to increase the petrol price by 25c/litre in order to remedy the RAF's "terrible financial situation"

The latest addition to our online information services is Words and Deeds, launched in response to the expressed need of property lawyers for uptodate news on developments in their field of expertise.  The publication is primarily an electronic bulletin designed to expedite the identification of material relevant to individuals by means of hyperlinks.

The introductory issues will draw attention to material available online from various sources as well as that housed in our libraries, particularly the identification of relevant journal articles, as members need to be aware of the resources at their disposal ;  future issues will be vastly abbreviated and will be distributed as judgments and other topical material becomes available.

The lists of relevant journal articles will be retrospective to a degree but the information needs to be accessible and not buried on our shelves.

Note : journal titles dedicated to property law will now only be indexed in Words and Deeds

Grobler v Naspers Bpk and Another [2004]5 BLLR 455(C)
Ms Grobler was the unwilling target of repeated sexual advances by a trainee manager in the department where she worked as a secretary for a number of months. When he was finally told where to get off, the trainee manager drew a firearm and threatened Ms Grobler. Before this, she had complained a number of times to the department’s manager, to no avail. When she finally approached the company’s HR department, the harasser was dismissed. This was too late. By that time, Ms Grobler was suffering form post-traumatic stress. After she resigned, Ms Grobbler sued Naspers and its former trainee manager jointly for R250 000 in general damages, plus medical costs and compensation for loss of income. Both the manager and Naspers denied that Ms Grobler  had been harassed ; Naspers pleaded in the alternative that even if she had been harassed, it was not liable

Maternal lapse
Wardlaw v Supreme Mouldings (Pty) Ltd [2004]6 BLLR 613(LC)
When she returned to work after maternity leave, Ms Wardlaw received a notice to attend a disciplinary inquiry. She was found guilty of failing to discharge her duties as group financial manager because she had performed various accounting tasks in a grossy negligent manner, which resulted in considerable loss to her employer, as well as tax penalties and interest. Ms Wardlaw was summarily dismissed. She referred the matter to the Labour Court, claiming that she was dismissed for reasons that related to the taking of maternity leave or, alternatively, that even if she had been negligent, her dismissal was unfair because she had not been correctively disciplined. She claimed compensation equivalent to 24 months’ salary

Le Roux v Afribind CC [2004[4 BALR 469(CCMA)
Whether the minority member of a closed corporation is an employee as defined in the LRA was the main issue. After the termination of Mr Le Roux’s relationship with Afribind CC, he referred a dispute to the CCMA, claiming that he had been unfairly dismissed. Afribind contended that Le Roux was not its employee, and that, if he was, there were good reasons for the termination of relationship and the termination was procedurally fair

What do parties have to prove if they want the Labour Court to close down a bargaining council? Two employers’ organisations who were reluctant parties to the respondent council argued, inter alia, that the council was not functioning properly

CEPPWAWU on behalf of Prins v Woodline Timbers [2004]4 BALR 431(CCMA)
Mr Prins, a boiler operator, was dismissed for assaulting one of his managers. He denied that he had done anything of the sort, and claimed in the CCMA that the employer had acted inconsistently by dismissing him
Point missed
Khula Enterprise Finance Limited v Madinane and others [204[4 BLLR 366
When Khula Enterprise Management was restructured, one of its top mangers was required to report to a newly appointed general manager, rather than to the managing director, as he had done before. The manager took exception to the new setup, and arguments followed. The manager was warned, but the situation eventually deteriorated to the point where he was dismissed for insubordination and gross negligence. A CCMA commissioner held that the dismissal was procedurally unfair because the disciplinary hearing had been presided over by a practising advocate, rather than an employee, and because the advocate had been briefed by the company’ attorneys

SAPU v SA Police Service and others [2004]6 BLLR 567(LC)
The 'right sizing' and transformation of the public service has led to a sizeable number of disputes being referred to the Public Service Co-ordinating Bargaining Council. Most of these complaints concern transfers to places considered unacceptable by the transferee. The council assumed jurisdiction to decide these disputes in terms of its own Resolution 7 of 2002, which governed the 'matching and placement' process in terms of which employees were promoted, redeployed or transferred in the process of transformation

NUMSA on behalf of Abrahams v Guestro Wheels [2004[4 BALR 520(CCMA)
Mr Abrahams, a despatch clerk, was dismissed for issuing false invoices for the sale of wheel rims to an 'undercover agent' and receiving money from the agent in return. Abrahams denied that he had been involved in any corruption. The agent gave evidence at Abrahams' disciplinary hearing

Barry v African Defence Systems (Pty) Ltd [2004]4 BALR 413(CCMA)
After African Defence System (Pty) Ltd indicated that it was considering relocating its operations in Natal and the Cape to its head office in Midrand, one of its senior employees, Mr Barry, reluctantly indicated that he was only prepared to accept relocation subject to certain conditions, which were not accepted to management
Neck pains
Tither v Trident Steel [2004]4 BALR 404(MEIBC)
Ms Tither, a telesales assistant at Trident Steel, was dismissed after she developed neck pains as a result of working at her computer. After many absences from work, medical boarding was considered, but the company’s pension fund ruled that Ms Tither did not qualify. She claimed that her dismissal was unfair because the company had not tried enough to find her alternative employment. Trident Steel claimed that it had made every reasonable effort to accommodate Ms Tither, and that she was unable to fulfil her contractual duties

Damages halved in newspaper defamation case - 31 May
Damages of R100 000 which the Cape High Court awarded to a fleamarket trader for defamation by the Cape Times have been halved in a landmark ruling by the Supreme Court of Appeal in Bloemfontein. The Appeal Court also overturned aspects of the Cape High Court ruling on Walleed Suliman's R3- million claim for reports in two editions of the Cape Times in August 1998, which claimed that he had been arrested as a suspect in the Planet Hollywood restaurant bombing days earlier

'We must change our mindset' - 26 June
Since June 2003, 220 equality courts have been established to eliminate the racism that took root in South Africa during the colonial and apartheid eras - as well as other forms of discrimination that can flourish in a culturally diverse society. "We must change the mindset of our people," Johnny de Lange, Deputy Minister of Justice and Constitutional Development, told participants of the conference, which was organised by the South African Human Rights Commission. 
"Equal opportunity alone is not enough to address the apartheid-inflicted legacy," he added

PRETORIA HIGH COURT
SA govt has no obligation to help citizens abroad - 27 May
There is no legal duty on the South African government to take any steps to protect its citizens in distress abroad, the Pretoria High Court heard on Thursday. Argument was being led on behalf of the government, which opposes an application for state intervention by 70 South African alleged mercenaries being held in Zimbabwe

Four factors not always present will influence GDP data due for release in November: revision, rebasing, benchmarking, and improvements in measurement of some economic sectors

The concerned group served a high court application on President Thabo Mbeki and the minister of Safety and Security requesting an order to delay the implementation of the act on July 1

An engineer working for America Online was arrested yesterday and charged with stealing 92 million e-mail addresses of AOL customers and selling them to spammers that were peddling penis enlargement pills and online gambling sites

AOL engineer sold 92m names to spammers - 24 June
Jason Smathers (24) was arrested on conspiracy charges at his home in West Virginia, close to AOL's headquarters, where he had worked since 1999. Sean Dunaway (21) who bought the list of 92-million screen names, was arrested in Las Vegas. Although detailed customer information was obtained, there is no evidence that any credit card details were stolen
