NEW WEBLOG
The beginning of a new year is an appropriate time to usher in some changes.  The first of these is to the format of InfoUpdate.  The bulletin has expanded beyond recognition since the first issue of Update . . . from the Library Desk dated 31 March 2000.  It is now emailed weekly to over 540 recipients in the legal, banking and IT sectors around South Africa and abroad.  However, the broad base of the audience as well as the increasing amount of freely available material in electronic format in this country has resulted in InfoUpdate getting a bit too big for comfort.  The email service will continue as it has in the past but news items will now be left out of the main bulletin as we develop an experimental weblog.

Weblogs have flourished in legal circles in America in particular and usually take the form of online diaries with links to items and websites that have caught the author's attention.  Their strength lies in the fact that they are updated daily, in some cases hourly, and can be a fascinating way to surf if one has the time.  The service we are launching is going to apply the best of these principles in order to make current news items accessible via our site throughout the day.  This material will no longer be carried in InfoUpdate itself ;  this is an improvement as what is topical on Monday has often been forgotten by the time InfoUpdate is distributed on Friday.  Click on the icon above to see for yourself.  Comments should be sent to mary@lawlibrary.co.za.

This application is directed, in essence, at reviewing and setting aside that portion of the decision of the first respondent in terms of which the separate fishing quota allocated for pilchards and anchovy was replaced by a single percentage quota for both. The gist of the complaint is that the quota had been allocated separately from 1984 to 2001, but in 2002 was allocated as a single pelagic fishing quota, split between pilchards and anchovies, in accordance with a complicated mathematical formula. As a rights holder in the pelagic fishery business the applicant, which trades as "Marine Products", avers that the new allocation was arbitrary and unreasonable, and demonstrated a failure by the first respondent to apply his mind properly to the decision made in this regard. In addition it is averred that the first respondent acted ultra vires in making the decision, which was in any event procedurally unfair

Paul Leatham Humphrys NO v Henry John Barnes
Voetstoots clause in a contract of sale of immovable property. A retaining wall collapsed, causing damage to the said property as well as the adjacent property. Question arose whether the plaintiff's negligence materially contributed to a totality of loss. Issue is firstly the concurrence of contractual and delictual claims in the present factual matrix. Contractual and delictual liability can exist side by side in the same factual scenario, but the voetstoots clause would only be of avail in the case of contractual liability, it does not exclude liability for anything else, such as for negligence or misrepresentation. There is no exclusionary or indemnity clauses excluding delictual liability within the contract. An automatic review in terms of section 302(1)(i) of the Criminal Procedure Act, 51 of 1977 relating to the application of parity of official languages, entrenched in section 35(3) of the Constitution, in court proceedings. The issue is which of the eleven of the official languages should be used as the language of record in court proceedings. If parity of the eleven official languages were to be adhered to in court proceedings it could result in a considerable strain in resources which, in turn, could impact negatively on the quality of service delivery and efficiency in the administration of justice. The solution to problems such as the one raised in this matter could be the introduction of one language of record in court proceedings. Although some stakeholders would take it with a pinch of salt, sanity would tip the scale in favour of English as the language of record in court proceedings, particularly in view of its predominance in international politics, commerce and industry. In the alternative the Accused were charged of malicious injury to property. Held: The test still remains the same as set out in R v M 1946 AD where Davis AJA (as he then was) stated: "...the Court does not have to believe the defence story, still less does it have to believe it in all its details; it is sufficient if it thinks that there is a reasonable possibility that it may be substantially true.” It is trite law that where there is doubt in a criminal matter, the benefit thereof must ordinarily be given to the accused person

Murder case: The State formally applied, by way of a notice of motion and founding affidavit for an order in terms of section 37(1)(c) of the Criminal Procedure Act 51 of 1997, (‘the Act’) read with subsections 2(a) and (b), that the investigating officer is authorised, in conjunction with a medical officer or district surgeon, to take a blood sample of each of the accused ‘in order to ascertain whether such sample(s) has any mark, characteristic or distinguishing feature by means of DNA analysis.’ The application is made by the State following the accuseds’ refusal to furnish blood samples in response to an informal request therefor.
