All lawyers must be able to advise clients how to transact business in the 21st century.  Our profession cannot afford to let others, such as accountants and management consultants, take this lucrative and interesting field of business away from it.

The Electronic Communications Act, which was promulgated on 30 August 2002, affects every business transaction.  Understanding its implications will help you compete effectively and take advantage of the new business opportunities it presents.  It creates many new legal issues especially those regarding intellectual property.  Your clients will be expecting you to advise them on local and increasing global concerns.  At all times you must be able to participate in the global community with which our country is now instantly and inextricably connected.

The business environment has also changed with the promulgation of the Promotion of Access to Information Act.  Privacy and security concerns are also very important and will become even more so with the passage next year of the Act derived from the Interception and Monitoring of Communications Bill as well as the forthcoming data protection legislation.

Media statement by Chief Justices of the SADC region concerning the threat to the independence of the judiciary in Swaziland

The following is a statement of the Chief Justices of Botswana, Lesotho, Namibia, South Africa, Tanzania and Zimbabwe :

The report of the attempts by senior officials of the Swaziland government including members of the security forces to frustrate the court proceedings in Swaziland concerning the alleged abduction of a young woman by emissaries of the Royal Household is a cause of great concern.  It is a direct threat to the indepencence of the judiciary whose responsibility it is to uphold the law without fear or favour.  The Chief Justice of Swaziland, and other members of the Court dealing with the matter, have refused to bow to this pressure and have made it clear that they will deal with the case on its merits and without regard to threats that have been made.  In doing so they have acted in acordance with the best traditions of their office.

The Law Council of Australia has established a strong organising structure, with a first rate faculty of practitioners, judges and academics from all areas of the law to finalise the business programme.  The Committee intends to consult widely in order to choose issues of relevance to today's lawyers, and details of the programme will be released soon.

The programme will include around fifty individual business sessions from a wide range of areas of concern to practitioners in all jurisdictions.  In addition, plenary sessions will address contemporary legal and social issues of common concern throughout the Commonwealth.  High profile Australian and overseas speakers and presenters will lead the sessions.

A huge technology, information and trade show will complement the conference, and give delegates the opportunity to experience the latest innovations to assist in their professional and home lives.

A feature of the conference will be a large number of affiliated meetings and seminars which, at this stage, include Commonwealth Attorneys-General, Magistrates and Judges, the Commonwealth Association of Public Sector Lawyers, Corporate lawyers, and the many sections and committees of the Law Council itself.

 

Melbourne is Australia's cultural and sporting capital city, and the 13th Commonwealth Law Conference offers a unique opportunity to travel and enjoy the city at its best.

The Commonwealth Law Conference is hosted by the Law Institute of Victoria on behalf of the Law Council of Australia and is being held, in April 2003, in the land of the Southern Cross for the first time since the 60s.  Following on the success of the Commonwealth Law Conferences in Vancouver and Kuala Lumpur, more than two thousand lawyers from every corner of the Commonwealth are expected to meet in the days leading up to the Easter break.

Constitutional Court - CCT18/02

On Thursday 7 November 2002 this Court will hear an appeal concerning the power of the High Court to commit someone to prison for failure to pay maintenance for child support. The case arises from a decision by the Supreme Court of Appeal to overturn an order made in the High Court committing a father to civil imprisonment for contempt of court after proceedings against him in the Magistrate's Court had failed to ensure that he paid maintenance.

The appellant contends that the issue is a constitutional one involving the rights of the child as protected by section 28 of the Constitution.

She is supported by the Commission for Gender Equality (CGE) which has been admitted as an amicus curiae. The CGE contends that the maintenance system is highly gendered and that its failure to operate effectively entrenches and exacerbates the existing inequality between men and women. To the extent that the High Court has a discretion whether to issue an order of committal for contempt, this discretion should be exercised in a manner which has due regard to the constitutional rights of women to equality, as well as to the rights of the child.

Both the appellant and the CGE state that the Supreme Court of Appeal was wrong in setting aside the committal order made in the High Court.

The respondent argues that the issue is not a constitutional one and that the Court has no jurisdiction to consider the appeal. He contends further that any discretion the High Court might have had to commit for contempt of court had been removed by provisions which provide for appropriate remedies in the Magistrate's court. He also argues that even if it is held that the High Court continues to have such discretion, such discretion should be used most sparingly and the Supreme Court of Appeal was correct in holding that the facts of the case did not support it being exercised against him in the present matter.
